We recently filed I485 for my K1 wife and got a RFE explaining that the I693 she handed over at the port of entry never made it to CIS. I presume it was lost at some point.
Because we already had the I693 on file due to her entry, we only filed I693A with our I485. However they never got the I693, so the RFE requests a new one from an approved Civil Surgeon.
However.. my wife is lucky enough to have another sealed envelope from her overseas examination with (we believe) her I693 + Xray in it.
Does anyone think I should chance sending this to USCIS ? Or would it be best to just pay for another examination and get a new I693?
One thing that makes me question the wisdom of sending in the overseas package is that the envelope is huge - bigger than 11"x17" at least - so I'm not sure how well it would survive mailing and/or be accepted.

I just went to Mumbai for H1 stamping and my previous visa on the passport had expired in 2006. So even if you are going for H1 stamping but your visa on the passport has been expired for more than 12 months...then you have to answer NO for this question.

The current "priority dates" for EB-3 as per USCIS is April-2001. Based on this, When can we expect our "485" to be filed and our EAD to be approved ?
I have a law degree from India (12+3+3) and currently I am pursuing a paralegal program from an ABA approved university. I might loose my job oppurtunities if I don't have a work permit. Is there anyway that I can get a work permit with my pending GC application process, without hampering the GC process ? Can I get a work visa (or EAD) based on my education ?

With a priority date of May 2008 EB3-India, unless there are legislative changes (or another July 07 fiasco) you are expecting a wait of atleast 4-5 years before you can file your 485 and get an EAD. Perhaps longer, considering how EB3 is ~8 years backlogged.
Your best bet would be get H1-B sponsorship.

My labour got approved but we still have to file for I-140. My h1b is going to expire on May 2007.

I called Board Protection Dept they said follow the latest date. which is Dec 05, 2009. anyone confirm?
You are paroled into US until Dec 05, 2009. But if you want to travel outside US after July 29, you better apply for AP now.

letter to india then she goes to stamping in india.

keeping H status also. You can keep ur H1 if your primary. If anything happens bad with your GC , she can go out and come back on H4. Just switch her to EAD , get a job.

I have a valid H4 stamping till Sept 2010. I got my H1B approved last year(2009) and COS from H4 to H1 approved. My H1B was effective October 1, 2009. Due to recession, I still have not been able to find a job. Now I want to change my status back to H4.
As I have a valid H4 stamping on my passport, can I travel across the border to Mexico, surrender my H1B I94 and reenter the US with a new H4 I94? Is that possible? Can that be done on the same day? Or should I apply for a COS - Form I539 and get it done here?
Please respond at the earliest.

Hi,
I entered the US on H4 visa. Last year I got my H1b approval but my I797 came with without the I94. When I went to apply for SSN they said they need the I94. My employer's lawyer said a change of status has to be applied for that but that can be done only once I have a job/paystubs.
Is that true?
But obviously I cannot have a job when I am actually back to my h4 status right now and cannot apply for my SSN.
What is required to apply for change of status from h4 to h1?
Are there chances of it getting rejected(since we have been hearing of so many petition rejections these days)?
Any help is greatly appreciated.

Recently, one of my co-worker who was on L1A, requested an extension of his Visa. His employer filed for an L1B instead and did not inform him until after filing it. Now USCIS has sent an RFE. Does anyone know if this can be grounds for rejection of his Visa? Is the employer legally correct in filing a changed Visa category at will without informing the holder? His wife is unable to obtain a driver's license since the Visa approval is pending. Does anyone know if this can be addressed? If so, how?

I-130 does play a role, when applying for visitors visa. but that doesnt disquialify anyone from getting visa. you have to show string ties to your country and provide enough evidence that you will come back. there are cases where they hv granted 10yrs multple visas !!
