    well said and I agree 100%. it is not as simple as saying that by buying now you are saving 12 months rent. (for one, you get a place to live which has flexibility..though smaller). if you need it now as said above it makes sense (and I would say if u need space because grown up kids need space or you have other family member staying (like parents etc) ..)
    I agree Texas did not see the boom that was seen in other places and hence is relatively a better place to buy. that being said, I guess it depends on location too ..even in good places (all except the super bubble states of CA, FL etc) ...make sure that location looks good (good school, less crime) ..and at the same time ..easy commute (who knows ..gas maybe $6 and rising in future)...ino ther words even in TX, if the houses were built far away ..then they too will fall in prices

    I think gas price is a non-issue. Gas in India is more expensive than in the US and considering the income there, the effective cost is even more higher. And yet, people continue to buy more and more without regard for increasing gas prices.

    The same logic applies here. Back in 2001, once gas prices starting going up and in places where gas cost $1.30, it hit $1.50 which people found "shocking". And yet, there wasn't the slightest reduction in the number of cars bought. Even now, with all the dismay at soaring prices, nothing much has changed. Freeways are just as jammed as ever.

    The fact is, the American is well equipped to deal with $6 prices. The reaction we see is is just due to the unpleasant thought of having to pay more. It is not a showstopper by any stretch of anyone's imagination. At the worst, it just means they will have to cut back on annual vacations which is not a big deal for us, but obviously a catastrophe to the average American.

    No (Yes if the person resides in the US while claiming SS benefits)

    Even with 40 credits it is not possible for Indian nationals to get SS payments in India. If you look at the rules closely on the SSA website, there is no simple way to get benefits paid in India unless you are a US Citizen. You must be present in the US for that

    The benefits to the porting are obvious. However let me share with you the considerations:

    1) You have to change jobs presumably on another H1b visa in order to do so. There is inherently a risk in this when you do not have a green card. You'd certainly be a brave soul to change jobs on an EAD based on your EB3 petition while trying for an EB2 petition. How would you justify the same/similar requirement?


    2) PERM labor certification is not going to be what it was previously given the current oversight.

    3) Ported cases will definitely get more scrutiny (and probably more RFEs) from the USCIS.

    4) Premium processing of 140 petitions is for a narrow subset of 140 filers who need to extend their H1b visas, failing which you are likely to take well over a year to get you 140 approved and therefore your PD ported.

    5) Political calculations and the elections will be over by later this year, there will definitely be the impetus to address immigration as an urgent issue in the new political cycle and there will likely be a solution. If you are at the 485 stage, with a retrogressed PD as your only issue then you have one problem, if you are at an earlier stage then you may not be approvable at the stage when they are "generous".

    If even after all this you feel your best chances are with EB2 then you should go ahead.

    This is why I said 221G is a good initiative. Even if people have to suffer a little bit, full check is needed for every visa stamping and every green card application.

    I guess its much better for frauds to have an EAD/AP, then they can easily bypass the checking at consulates.

    Some of them got approvals and some rejected.

    I have applied for I -140 (EB2) but I am with 10+Diploma(3 years) +Bachelors of Electronics from Mumbai Univerisity(3 years).

    PTO is a new one for me. Paid Time Off??

    You can work with the new employer while H1B is pending, for 240 days as far as I know. There is premium processing if H1B doesn't come on time.

    3 days without pay is not a gap in employment if the employer-employee relationship is maintained. Don't worry too much. Even in normal circumstances, it takes a few days to relocate.

    Yep. Paid Time Off (PTO) - This will allow me to get regular checks until PTO is exhausted.

    Actually, my question is it LEGAL to work for the New employer (After filing H1B Transfer and getting the receipt) when on PTO (Paid Time Off) with current employer?

    Thank you for the info. You might be correct. But there is no way for us to know that our application got transfered or not. I am just assuming this is the case for me so that I can feel better and not to worry for a while. I filed on July 19th to NSC. 140 approved from NSC.

    My lawyer says "If we file the I-140 based on the LC-PERM, we would interfile it into your pending AOS, so your AOS would be pending based on the pending I-140 (NOT the withdrawn LC Sub)."

    Is it possible to interfile if the PD is not current? My pending LC SUB and the PERM LC PD, both are not current. Please confirm whether it is true or not. This will help me make my case.

    There was a problem in the first two of seven D70s I've used. The focus calibration was off by about a tenth of a millimeter. This means that your images will not be focused on your subject, but instead on something somewhat behind your subject. Don't confuse this with the common mistake of having selected the wrong AF area or otherwise pointing the AF sensor to the side of your subject. Nikon of course will adjust this under warranty if it's a problem. With common f/3.5 and slower lenses it's not much of a problem, and at regular shooting apertures of f/8 or so its completely invisible. Some people incorrectly call this the "backfocus" problem.
    On the other hand, if you have fast lenses that alone cost more than the complete D70 kit and you shoot them wide open you ought to check your camera. My $1,700 28mm f/1.4 lens (http://www.kenrockwell.com/nikon/2814af.htm) wide open at f/1.4 was useless on two cameras, but of course OK at normal apertures. You won't see this through the finder. You have to look at the images at 100% on your computer. It's simply the image being focused on something just a little behind where it should have, which is usually invisible if you have enough depth of field, and of course Nikon will stand behind it if it really is a problem. The samples I've used in May 2004 now seem AOK and mine is perfect, even at f/1.4.

    Heck, my D70 focused better than any other camera I've owned, even with my f/1.4 lenses.

    Testing this is simple. Just go make at least a dozen photos with your lens wide open and look at the results at 100% on your computer. See if the camera really focused where it should have. If you haven't done this kind of test before there's the potential that your technique may be off and not looked for it before, but you get the idea. The only concern here is that you need to have the focus be where you put it.

    This miscalibration is the reason some people think their D70 images are soft. They aren't soft; they simply are focused on the wrong thing!

    If your camera is out of adjustment, which I only saw on some of the very first samples, of course it's covered under warranty. If you are crazy, like this guy here (http://dvdhelp.narod.ru/D70_back_focus.html) (look out, it's a slow loading page), you can use a nail to mess it up further and void your warranty at the same time. I don't have this much guts; the D70 has a year warranty and I know your camera isn't that old! On the other hand, I respect his innovative spirit and it's this pioneering spirit which makes him an honorary American as far as I'm concerned. Please use a real Allen wrench to make these adjustments, and remember that Nikon will do it correctly for you for free under warranty and probably clean your camera as well at the same time!

    we all know that the process is broken. we all know that we face long years of waiting because of retrogression. ask BEC filers how bad things can become suddenly. ask people whose name checks have not cleared in 3 years.

    we have our choices. we can wring our hands about who gets receipt notices first and whose ead comes faster. or we can try to be the grassroots organization that immigration voice really is (rather than exclusively an info forum for tracking dates) and stand up to petition for reform

    these are just today's irritants. with 1 million applications at various places in the line, there will be many more tomorrow.

    please choose wisely.

    Last time around exactly the same time in 2006 CIR took off like crazy because of the tremendous backing of Senate Judiciary committee chairman Arlen Specter and Senate majority Leader Bill Frist (who actually gave a deadline for a the bill to be introduced to the senate floor, to speed it up) and president bush supporting it as well. In spite of all these it took the senate from Feb-march 2006 to around September 2006 to get it passed.


    In 2006 Senate had passed S2611 late may as I remember with a fair margin...

    Hi Guys,

    I need your help on this. My cousin is running this small IT company in india and he mentioned that when US client sends their money to India via Pay Pal or some secure money transfer , they are charging them 4 % of transfer amount.

    He ask me that what could be the best way to avoid this fees , some of the option that we thought about,

    1) If they (cousin's company) open an bank account in USA and utilize this to transfer the money to indian bank account - Would they still need to pay US tax as money is being deposited into the US account?

    2) If I utlize my bank account - I think in this scenarion I have to pay the US tax for whatever money the client is depositing into my account in order to make this legal transfer

    3)If US client utilize remit2india, ICICI to transfer money which I highly doubt

    I appriciate your responce on this.

    If you are working on H1, #2 is not an option. You will be violating immigration laws by accepting payment from unauthorized sources by doing so.
