    Still haven't had time to even open Photoshop, I'm hoping to get to it tonight. I get my new labtop on monday so I can work on the battles at work also and upload. My first volley or two will be lame, but by next week I'll have some more resources to work with and time. Expect it tonight or tomorrow morning.

    Get a new passport and when re-entering with the new passport, show the expired passport with an unexpired visa. Unexpired Visa in expired passport is valid and can be used to re-enter.
    That's the best way. You have to leave before your current I94 expires.

    Non-Immigrants - All talk and no action?

    I have been a silent member of ImmigrationVoice.org, a group formed by and for Highly Skilled Non-Immigrants wishing to legally migrate to the US to lobby Congress for reforms. When I first heard about ImmigrationVoice on another immigration bulletin board, I was curious to find out what their agenda was. With an ambitious goal of reforming the immigration system to favor the Highly Skilled Immigrants and with a little over 200 members, I was one amongst the next 100 who hoped that this then small organization would make a difference and signed up. I am here on a H1B work visa and still have 3 years left. I know that this struggle has to start for me now for it would be too late.

    By now, the organization had grown to almost 3000 members and with a dedicated team of advisors and group members, they made a bang in the immigrant community last year by going on a PR spree and even rallied amendments through prominent pro-immigrant senators and lobbying firms to include/introduce amendments in the failed 2006 CIR bill, all through meagre finances (compared to other anti-immigrant groups) albeit rich with passion and hope.

    I consciously started donating not because I was hoping that something WILL happen, but atleast with the hope that I tried to make it happen and that I can proudly go down if it didn't. People have almost always benefited from the actions of a small group of highly motivated individuals who tried and tried and tried. Some succeeded but some failed. Those who led and won will make history. Those who followed and won will proudly remember the history. Those who refused to follow and still won will with guilt remember the history.

    Hope is the quintessential trait of a successful person. If I knew how to predict the future, I wouldn't be here. What is important is that behind hope there is always strength. Mahatma Gandhi once said that "Strength does not come from physical capacity. It comes from an indomitable will".


    Every non-immigrant has the indomitable will to succeed based on his/her definition of success. I had the indomitable will to fly 12,000 miles to a destination I had never been to, clutching a scholarship and hope. I had the indomitable will to persist after 9/11 to find a job. If I didn't I would have called it quits and returned back home. My friend almost got killed at a gas station. Why? He had the indomitable will to try to stand up on his own to pay his tuition and living expenses. There are several stories of sacrifices and will power that constantly amaze me even till this day. One guy worked at a meat packing plant to earn minimum wage while simultaneously studying for a triple major. The worst part of his story was that he comes from a strict indian family of orthodox brahmins who by tradition and religion consider all living beings sacred.

    When you hear these stories of how people have lived their lives to reach wherever they are, lobbying for a reform should be an easier task. Its not rocket science. Just like americans, we non-immigrants take our rights for granted. "We pay taxes. We pay Social Security. We pay Medicare. We pay state taxes. etc. etc." SO WHAT? You drive a car, get excellent health care, make enough money to buy your parents a house/car, parade yourself everytime as the rich successful lad who left the shores to the land of opportunity everytime you visit your motherland. At what cost?

    Sometimes, Charles Darwin's quotes come to my mind; Like this one - "It is not the strongest of the species that survives, nor the most intelligent that survives. It is the one that is the most adaptable to change."
    We, non-immigrants adapt ourselves to the utmost degree that we almost always end up trying to find the easy route in order for us to preserve our way of life in the name of adaptiveness.

    John Porter counters Charles darwin by saying-"People underestimate their capacity for change. There is never a right time to do a difficult thing. A leader's job is to help people have vision of their potential."

    In my humble opinion, that is exactly what ImmigrationVoice.org has been trying to do.

    Off late, it seems that a majority of the members seem to bring in their own agenda and rally behind their own agenda completely devoid of ImmigrationVoice.org's objectives. There was not one bulletin board thread which has never sidetracked from the topic of discussion. In the name of constructive criticism or the character of the devil's advocate, a small minority have caused confusion and resentment of the objectives of ImmigrationVoice.org. For those members, I suggest that you read the objectives of ImmigrationVoice.org and subscribe to them or look for another group with common objectives such as yours.

    I have always had the opinion that if you can't get it done, step aside and let someone else do it. Observe, encourage, argue with a discipline and respect like a professional, but don't leave. Every single ounce of hope is required to achieve ImmigrationVoice.org's goals. Its hard to convey emotions through words, but I do know that deep within every non-immigrant's heart, there is a passion for success, hard work, commitment and willpower. If not, we wouldn't be forcing the nation/world to take notice of us or atleast try doing so.

    I am proud of IV!
    Yesterday, I felt proud to be part of a crowd that is so dedicated, selfless, hardworking, fearless, educated, discplined, understanding!!
    Each one of you were an inspiration. I cannot thank you guys enough for all your effort.
    Logic Life's speech was awesome. I wish he can post it here too, for people who missed it. Vandana....you are the rock star we need!
    Franklin is full of energy!!!!!!!
    People were thrilled to finally see/meet Aman. He deserves the respect he gets from IV members!
    I could go on and on......I have so much to say! Will continue the story in my next post.

    Thank you all, for helping me out with everything. We were like a family...looking out for each other. I really felt sad when I was coming back from D.C. Is there a way, all of us can stay there in the White House :)

    Here is my situation:
    I-140 approved - PD: May '06
    I-485 filed - July 30 '07 (India)
    EAD cards - Received
    APs - Received

    Due to a slowdown in their business, my employer is laying me off in Dec '07. I'm still short of 1 month to complete my 180 days of I-485 filling. However, they said they will not withdraw my I-140 and, to help me, will in fact keep me on their payroll until Jan '08, with my Jan '08 salary as my severance and my official status as on "paid leave". So far, so good.

    I also have a job offer, and my new employer wants me to join them in Dec '07, on EAD. My question is: Can I be officially on the payroll of two companies simultaneously on H-1B and/or EAD? If yes, do I need to inform the USCIS of my status (new employer; AC21)? My other option is to say No to the new (attractive) job offer (or to try to convince them to wait until Feb '08, which they'll likely not agree to), and and take up another job in Feb '08, on EAD / H-1B transfer, using AC21. Please advise whether I'm fine with using the first option!!

    I hold high regard for your postings...but in the 765 manual, I could not find any such rule that you just mentioned..Here is an excerpt from Pg 9 of

    We understand that http://www.uscis.gov/files/form/I-765instr.pdf is main reference.

    This document also summarizes where to send EAD application: http://www.visapro.com/US-INS-Forms/Form-I-765.asp.

    -- #1 Either Service Center with jurisdiction over your residence (NSC or TSC)
    -- #2 or Local Office - depending on where your case is pending

    The #1 is consistent with http://www.uscis.gov/files/form/I-765instr.pdf. I am confused about it #2 and perhaps my interpretation is not correct. NSC and TSC is not Local Office. As long as case is with NSC and TSC, we may need to send I-765 based on juridiction.

    People are filing based on #1 and #2 above and it has been going OK. Seems that USCIS is able to process regardless.

    I have gone through interview and it is nothing to worry about. They are just distributing the workload. IO will check your documents etc..and then will issue GC if visa is available or throw it into storage like mine.

    yes. there is a possibility of some retrogression for EB2 India/China in the comming bulletins. But that is just for few months and it might be a mild retrogression as long as there is horizontal fall outs of spill over visas.

    "possibility of retrogression"???? thats sounding like a weather forecast. :)

    lets have a specific prediction here. Can you pick an year and month for EB2-India for the October 2008 Visa Bulletin (start of new fiscal year)?
    Ron Gotcher believes EB2-India will be somewhere at 2002/2003.

    They will not get I-94 for more than 6 months. You need to do following things to claim them as dependet(s) -

    1. Extend their stay beyond I-94 i.e. 6 months.
    2. Get ITIN number for them. (I am not sure how you get it on B1/B2)

    This is the primary reason, immigration does not give more than 6 months I-94 on B1/B2 and avoid extending their stay....even if those are genuine reason(s).

    My parents only stay here for about 170 days/year. Though, for every 30 days they stayed here last year, I can count 10 days towards their substantial presence in the US this year. That's how they can pass substantial presence without staying more than 180 days any single year. And B1/B2 visa holders can get ITINs. Undocumented immigrants who had no visas, in many states could use their ITINs to get Driver Licenses. IRS recently cracked down on this practice and asked all agencies to stop accepting ITINs as a form of identification and also made it harder to get an ITIN, but visa holders can get one. You may need to take the applicant (with their valid passport and visa) to an IRS office for verification. They can then accept the form in person, and return you a stamped copy of the application

    I would love to take the lead with this project. I have done a fund raising initiative for Arthritis Foundation of America when I ran the Mardi Gras Marathon in honor of my mom. I raised $1,100 in a 6 month period for the AFA. The idea I have is that Team IV members will participate at their local events and we should pick 3 national events such as the Chicago Marathon/Half Marathon, the Breakers 10K (is that San Diego?) and even the Crescent City Classic 10K right here in my hometown. Team IV should be well represented at these 3 national events.

    Team IV members can set up an e-mail support group when training for any events. There are numerous on-line training guides which we can use. And I can also look into the idea of an on-line training coach.

    I already have the committment from 4 friends, all of whom are US Citizens, to join this Team because they support our cause.

    This is great NolanIndian and I wish you guys all the best!!! Unfortunately I am going to have to watch from the sidelines so to speak as I have ongoing bursitus from marathon antics in 2006--Go IV and watch out for those joints and tendons ;)

    L1 A are managerial positions. they can apply in EB1 through employer. Hence it is possible to get GC in Green Cards.What he is saying is true.

    L1 A are managerial positions
    L1 B are like H1B except they worked for their parent company for a period of 1 year or more out of US

    L2 's get EAD within 8-12 weeks and they can start working.

    But unless he uses GC and get out of that company, he wont be earning near to minimum H1 B wages.

    Satyam pays L1B only 41K. that's pathetic. Same with Wipro, Infosys, TCS , they are misers for L1 and H1B for employees.
