    Dear members,

    I am on H1B with I-485 Pending and i have layoff coming. I have Approved EAD but i haven't used it. How much time I have to find another job without loosing H1B Status?

    I appreciate your help

    Im july 5th filer .NSC_CSC_NSC.got my EAD on 20th december07.AP still pendind at CSC (RFE).opened SR for FP in october and got FP notice next day .Obvously SR had nothing to do .SR was replied after 45 days and says "status of I-485 USCIS is waitinf biometrics information to produce permanent residency card .I had filed 140 and 485 conc.and my PD is current .I had seen lot of NSC_CSC_NSC got their FP notices in mid november .

    gc_chahiye, Thanks for your response. So, can I be on H1 with my current employer, A, and on EAD with my new employer, B, simultaneously?

    Also, employer B might be able to start me on H1-B (my preference--just in case)--though as you said, B will have petition my new H1 for concurrent filing. My other option, of course, is to wait until Feb '08--though I'll miss out on a month's salary from B (not a biggie in order to not have any potential issues).

    Why dont you just work for your new employer in december on voluntary basis and take the salary in Jan as a signon bonus?. This way you will have a clean record of 6 months on H1.

    Please make sure you use your credit card wherever you get a receipt with your signature on both sides of the border to prove that you have left the country and the dates on the receipt will verify the same.

    Taking your car to Canada is useless as you will end up paying CAD 200 just for processing and then even though your car is good for Canada it will not pass the testing in that country which has to be done within one month of entry. To do the modifications it will cost you hell. I have experienced the same and got fed up and then reexported my car back to US only by sending them a notarized letter saying the car is back in US. I have PR card and went to Canada only temporarily to make my time to re validate my PR, now I am in US

    When the officer at the Canadian side will fill up the import form for all your personal goods , you can ask him to stamp your passport which will prove your stay and time in order to obtain the Canadian Citizenship.

    Dude nothing is rosy in Canada as there are very little jobs and highly qualified people are driving Cabs and doing laborer's job.

    They will stamp for the latest i797A. The old one is obsolete. If you notice the I94 numbers are the same.

    You are right on the I94 numbers; they are the same. But how come the old one is obsolete. Its valid till June 2007. And the latest 797 is from July 07 till July 2010. They'll have to combine both I797's dates to stamp till 2010 or they'll go with the first 797. Am I right??

    I have 4 years degree with Masters. However, if you made through EB3 you should be able to get through EB2. Nevertheless, it is worth a try as gains are large. I understand there is a risk (no risk no gain).
    I have just started the process and my labor is in process. I am filing with my current employer who filed my EB3 case. Green card is for future job so they are taking me for higher position say manger. My lawyer is making sure there is some kind of sync up with Eb3 labor and H1B application. They should be supporting the present labor application.
    Your employer need to be supportive and should be willing to work with you that help a lot. They have added some managerial stuff and kind of technical lead. I have not used my experience with present employer.
    To best of my knowledge, there is no impact to eb3 case.

    I don't think there's any relationship H1-application. H1's for current employment where as PERM labor is for future employment. Future meaning, after your 485 has been approved. One doesn't even need to be on H1 to proceed for Eb3 to Eb2 conversion.

    Are we doing anything to get the support of orgs that are not community based ? I don't see how getting the support of an org based on an ethnic community "broadens the base".
    Well, the actual goal is advancing our cause. This endorsement will actually raise awareness about our organization - I guess, that does not qualify as broadening the base for you! But, whether it broadens the base or not - it definitely advances our cause!

    And, while somebody is actually doing something,what are you doing about advancing the cause?

    This particular support actually helped advance our cause a lot, much more than can actually be revealed on Forums. So pipe down, and do something creative! Why don't you try to get the support of the non-ethnic organizations - call the IV core group to offer your services, and get cracking on it!

    Inform to SSN Office that you are leaving the country. It will make sure that nobody if steel your identity misuse your SSN. If some point in future if you return to US your credit history will not be bad.

    Just send a letter for address change to US Imme office also get stamped in your passport about border crossing at US point.

    I also had Canada PR but can not find a good job so cancelled it. I found that India is far better than Canada.

    HOUSTON: A federal jury has found five people guilty of conspiring to obtain fraudulent work visas for nearly 90 Indian nationals in exchange for at
    least $20,000 per visa, the US Attorney's Office said.

    Mahendrakumar "Mack" Patel, 55, Rakesh Patel, 36, Alberto Pena, 38, Bernardo Pena, 38, and Marte Othon Villar Sr, 48, encouraged and induced the illegal immigration of Indian nationals in exchange for tens of thousands of dollars per visa, a statement from the US Attorney's Office said yesterday.

    The jury found that Alberto and Bernardo Pena, twin brothers from Brownsville, along with co-defendants had encouraged and induced 87 individuals from Gujarat to unlawfully enter US on temporary H-2B visas, knowing that the Indian nationals did not intend to work for the company that was used to get visas for them.

    The brothers also knew that the visa-seekers did not intend to return to India when their 10-month visas expired, a statement said.

    Pena twins also travelled to India to assist the Indian nationals with the application process and visited and corresponded with the US Consulate in Mumbai.

    Two other co-defendants -- Mack Patel of Ft Worth and Rakesh Patel, a Houston pharmacist -- pleaded guilty for recruiting Indian citizens who were willing to pay $20,000 to $60,000 in exchange for visas to enter the United States

    This reminds me of frog mentality to pull someone else down on some pretext or the other.

    What is the definition of "fairness"? Just because my application is waiting to be attended by an adjudicator and others are getting approved doesn't mean that I need to cry out foul. And if we do care for "fairness", whatever "fairness" means to us, then what are we doing, as a group, to seek fairness. I hope you agree that just by posting 3 messages per day on this forum and labeling system "unfair" "broken" etc, system is not expected to start working in a fair way. If you look at the thread to call lawmakers, there are hardly 30-35 people who actually called the lawmakers office. I am not telling you to call or do anything other than helping to make the system "fair".

    I don't know what your circumstances are, however I would recommend that you stick around for a few more weeks before you join the new company. You have already waited this long. And like lazycis rightly said AC21 may only be invoked 180 days after 485 receipt date.
    As far as job description goes, ask your new company to specify the title as Programmer analyst and provide a job description that includes "database administration" among other things specified in your Labor/I-140.
    I know that it is easier said than done when things are not in your control, however we can atleast try.

    Thanks for your reply. My main question is, if I do the H1B transfer (to a company other than the one that filed my labor, 140, 485), who has to submit the application for my spouse's 485 (when the priority date becomes current), my new employer or the old one that originally filed my 485?

    your wife's petition is based off yours, you dont need any LC/I-140 filing documents for that. Your I-485 receipt and/or I-140 approval notice copy is what you will need to include in her application. Other than that there is nothing needed from either X or Y. So it does not matter whether the petition is filed by an attorney from X, from Y, or from your own independent attorney. You can even file it yourself without involving attorneys...

    We are talking two different things here. You are saying about AC-21. The OP is asking about retaining PD. The way you can retain your PD after I-140 approval is :-

    You file a new labor with the new employer - once it is approved - you need to file a new I-140 application and attach the old approved application with it - this would ensure that your PD will become the PD from the old case.

    Difference with AC21 is - in the case of AC21, you just switch jobs and your current GC process continues - you do not have to file a new labor,140 etc.

    My checks got encashed this friday. Applications were delivered to NSC on July 2nd, later forwarded to TSC. My I140 was approved in TSC.

    My current EAD got expired by 08/27/2010 and I filed my extn by 07/06/2010. My check has got cashed by USCIS with in a week period of time. So I thought would get my EAD asap. But it didnt. Since my EAD extn filed to Nebraska Service center, called them on 1-800 and spoke with one of their representatives to expedit the process. I got a reply back from USCIS that they will expedit the process and the result should notifiy by within 30days.

    I already in LOP, I dont know how long the process will take..? If anyone knows how could I do better, please let me know the details.

    NOTE: Seems my priority date is also became current (Mar-30-2006). Would it cause for the delay..? Will they provide EAD and GC simeltaneously...? or Will I get EAD alon..? or will I get GC...?
